Terms and Conditions

Deposits, Payments, and Cancellation
Any payment or deposit will be applied to the service for which it is made. All deposits and payments are non-refundable. Online services or training programs are not refundable. Open enrollment class cancellations must be received in writing (email is acceptable, though receipt must be acknowledged) at least 4 days (96 Hours) prior to listed start time of class. Private class cancellations must be made 7 days in advance, unless otherwise agreed to by FTI. No reason is necessary to cancel. Qualified cancellations will result in a one-time credit valid for 12 months from the date of the original service or class, as posted on the website. (See the REFUND AND RETURN POLICY below)

Copyright
The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of Firearm Training Institute. The collective work includes works that are licensed to Firearm Training Institute. Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Firearm Training Institute or purchasing Firearm Training Institute products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorized by Firearm Training Institute. You further agree not to change or delete any proprietary notices from materials downloaded from the site.

Typographical Errors
In the event that a Firearm Training Institute product is mistakenly listed at an incorrect price, Firearm Training Institute reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Firearm Training Institute reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Firearm Training Institute shall issue a refund in the amount of the incorrect price.

Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Firearm Training Institute without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Notice
Firearm Training Institute may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Firearm Training Institute.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the State of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Firearm Training Institute products or services) shall be in the state or federal courts located in the State of California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Firearm Training Institute products) must be commenced within one (1) year after the claim or cause of action arises. Firearm Training Institute’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Firearm Training Institute may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Firearm Training Institute or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer
Firearm Training Institute does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Firearm Training Institute is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Firearm Training Institute reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Firearm Training Institute in its sole discretion.

Indemnification
You agree to indemnify, defend, and hold harmless Firearm Training Institute, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Third-Party Links
In an attempt to provide increased value to our visitors, Firearm Training Institute may link to sites operated by third parties. However, even if the third party is affiliated with Firearm Training Institute, Firearm Training Institute has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Firearm Training Institute. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Firearm Training Institute seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

What information do we collect?
We collect information from you when you register on our site or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to enter your name or e-mail address. You may, however, visit our site anonymously.

Overview
This page provides information about Federal Laws, steps that must be followed, and notes on using specific shippers when shipping firearms. This page is oriented toward the seller of an item. If you need information about how to buy a firearm through Firearm Training Institute, please contact us directly.

This page contains information oriented toward persons shipping firearms within the United States. For sellers located outside the United States, please contact us directly.

Shipping Legalities
Federal Law requires that all modern firearms be shipped to a holder of a valid Federal Firearms License (FFL) only. The recipient must have an FFL; however the sender is not required to have one. Any person who is legally allowed to own a firearm is legally allowed to ship it to an FFL holder for any legal purpose (including sale or resale).

Here is exactly what the ATF ‘Federal Firearms Regulations Reference Guide’ (ATF P 5300.4) says:

(b9) May a nonlicensee ship a firearm by carrier? A nonlicensee may ship a firearm by carrier to a resident of his or her own state or to a licensee in any state. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

(b8) May a nonlicensee ship a firearm through the U. S. Postal Service? A nonlicensee may mail a shotgun or rifle to a resident of his or her own state or to a licensee in any state. Handguns are not mailable. A common or contract carrier must be used to ship a handgun. A nonlicensee may not transfer any firearm to a nonlicensed resident of another state. The Postal Service recommends that longguns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms.

‘Antique’ firearms need not be shipped to a licensed dealer. These can be shipped directly to the buyer. An antique firearm is a firearm built in or before 1898, or a replica thereof. The exact ATF definition of an antique firearm is:
Antique firearm. (a) Any firearm (including any firearm with a matchlock, flintlock, percussion cap, or similar type of ignition system) manufactured in or before 1898; and (b) any replica of any firearm described in paragraph (a) of this definition if such replica (1) is not designed or redesigned for using rimfire or conventional centerfire fixed ammunition, or (2) uses rimfire or conventional centerfire fixed ammunition which is no longer manufactured in the United States and which is not readily available in the ordinary channels of commercial trade.

Knives, air guns, accessories, and most gun parts need not be shipped to an FFL holder. We say most gun parts because each firearm contains at least one part that the ATF considers a firearm. This part is typically the part that contains the serial number. This part must be treated as a complete firearm when shipping the item.

Ammunition: Ammunition must be shipped separately from packages that contain firearms (including handguns). Special labeling is required. Some shippers treat ammunition as dangerous or hazardous materials. Guidelines vary by carrier please check directly with the carrier for specific details. Effective immediately, required as of Jan 1. 2014: New Diamond-shaped Ammo shipping labels replace “ORM-D.”

The section of the US Code that governs modern firearms is called Commerce in Firearms and Ammunition (CFA). This code is available online at: http://www.access.gpo.gov/nara/cfr/waisidx_09/27cfr478_09.html

When in doubt, we suggest arranging for transfer through a licensed dealer. Violation of the CFA is a felony and penalties for violation of it are severe.

REFUND AND RETURN POLICY

General

We offer a return policy for merchandise, goods, and products (herein known as “products) as follows:
· Products must be returned within 14 days of order date or verified date of receipt of products indicated by tracking/delivery service if the customer requested that shipping method
· Products must be un-used, in original packaging, and contain all items that were present when new
· Products must be in sellable condition free from any signs of use, damage, installation, or wear
· Products must be returned to Firearm Training Institute (FTI) and the customer is responsible for the safe delivery of products

To initiate a return you must contact us and request a return authorization number, no returns will be accepted without prior authorization. The customer is responsible for any return shipping rates or fees and the original shipping rate or fees will not be refunded.

Any products that are defective when received maybe returned for an exchange of the same product only or a warranty claim may be made directly to the manufacturer.

There are no refunds or returns on any sale, special purchase, or group buy items. All of those items are sold as is, all sales final. Items in those categories will be listed as such in the title, description, or attributes. In the event a payment is received for a group buy item and the group buy is cancelled, the payment will be refunded and/or account credited to the customer within 3 business days of the group buy cancellation date. The customer has the choice of receiving a refund by check or having store credit to be used on other merchandise or training/services. Please order carefully.

Training Courses

There are no full refunds after a student has scheduled and paid for a training course, whether or not the course was completed by the student. Cancellations may receive a non-transferable voucher valid for a future course of equal or lesser value that expires one year from the start date of the original course. This decision is made on a case by case basis at the sole discretion of FTI. Factors that are considered include resources or materials already purchased for the class by the company, as well as lease agreements, rental fees, range fees and other expenses or fees paid by the company.

We cannot be responsible for logistical issues that cause delays or schedule changes, these situations could include national disasters, acts of war, acts of god, location availability, hazardous weather that would make training unsafe, or other reasonable issues. Likewise we encourage all of our students to plan and prepare accordingly as we can’t be responsible for your delayed flights, road delays, travel issues, in-climate weather or other related costs of delays or schedule changes.

If a student is unsatisfied with the training course that was conducted by Firearm Training Institute, the customer must contact us and file a petition explaining why they feel that way. Upon receipt and approval of petition the customer may receive a non-transferable certificate valid for a course of equal or lesser value valid for one year from the date of the original course.

For hosted courses, the customer is responsible for knowing and understanding the hosted instructor’s refund and return policy.
